Job Description

We are seeking a Legal Advisor to oversee legal, compliance, and risk management responsibilities for operations, as well as the management of retail, commercial, and industrial property portfolios for our clients. The role will involve handling sale and leasing transactions, ensuring compliance, and managing legal matters related to the properties under management.

DUTIES
Legal advisory:
  • Lease & sale transaction advice;
  • Drafting, perusing, vetting, negotiation and settlement of related lease, sale and other documentation & agreements pertaining to the Clients; and Statutory, regulatory and other legal advice to meet and the Clients requirements.
Compliance:
  • Legal, compliance and risk management responsibilities in respect of own operations as well as the management of the Client’s Properties under management.
  • Strong focus on the statutory and regulatory compliance in respect of the above, including but not limited to -
  • FICA, including the money laundering reporting officer (MLRO) role/function & Risk Management Compliance Programme duties;
  • Property Practitioners Act and Regulation;
  • Protection of Personal Information Act (POPIA), including deputy information officer role/function;
  • Consumer Protection Act (CPA); and
  • Occupational Health & Safety Act (OHASA) & Regulations.
  • Formulation, implementation, oversight, and review of policies
Risk management:
  • Risk mitigation via applicable insurance products;
  • Policies – refer to above; and
  • Fulfilling the MLRO role in ensuring that complies with the FICA, with duties set out in the RMCP.
Corporate & client governance:
  • Ensuring that all the Client mandates/resolutions are in place and signed, as well as ensuring that the Clients’ management meeting agenda and minutes are drafted, circulated and issued timeously.

Stakeholder management:
  • Engage and maintain good relations with all Properties’ stakeholders, including - The Clients; team;
  • Service providers and contractors, including security, cleaning and facilities’ suppliers & vendors;
  • Regulators and governmental bodies: E.g. engagement with the Property Practitioners Regulatory Authority (PPRA), FIC, Information Regulator, local authority etc; and Tenants.
Transactional:
  • Negotiate and conclude sale and lease transactions.
PPRA:
  • The successful candidate will be required, once appointed, to register with the PPRA as a candidate property practitioner and successfully complete the PDE4 qualification within the timeline prescribed by the PPRA to become a full status property practitioner


Requirements

  • LLB degree and admitted attorney of the High Court.
  • 1-3 years’ experience post admission as attorney of the High Court.
  • Business and legal writing skills (including skills to draft agreements, legal correspondence & legal opinions), IT literacy (MS Office suite, including excel), administration skills, valid driver's license (successful candidate may be required to travel in South Africa from time-to-time).
  • Legal knowledge and experience associated with an admitted attorney of the High Court.
  • Problem solving & decision making, customer relationship building, communication, team leadership, legal & business acumen, confidence, eye for detail, assertiveness; negotiation; analytical thinking; tolerance for stress; resilience, time management, ability to work independently, attention to detail, strong communication (verbal & written), and well organised.
